LES FAITS
Crash & Mars est l’émission matinale de la station de radio de musique pop-rock CKNO-FM (NOW! Radio, Edmonton). Elle est animée par Crash et Mars avec leur coanimateur Ginge. Le 24 janvier 2018, peu après 8 h, la discussion a porté sur les chansons de mariage trash (vulgaires) et sur un vidéoclip circulé par les médias sociaux qui montre une mariée quittant sa réception au son de la chanson « Crazy Bitch » interprétée par Buckcherry. Crash explique que Ginge est en train de supprimer le mot anglais fuck à tous les endroits où il se présente dans la chanson tirée du vidéoclip avant de la diffuser.

Crash: Tout. Ginge a littéralement retiré jusqu’à 15, 20 bombes-f de cette chanson-là.
Mars: Bien, en tout cas il tâche frénétiquement d’y arriver. Et comment ça se présente?
Crash: C’est, c’est presque –
Mars: Oh, il lui reste une seconde, qu’il dit.
Crash: C’est maintenant que ça arrive.

Ils font alors jouer la chanson. Ils ont réussi à assourdir la plupart des fuck, sauf pour deux. Les paroles défilent comme suit:

Crash: Juste avant qu’on se confonde en admiration, ici sur NOW, j’ai dit comme, « Ginge, pourquoi on ferait pas jouer ce morceau de Buckcherry, “Crazy Bitch?” » « Oh mon Dieu! », qu’il me répond, « il y a plein de bombes-f dans ça! »
Mars: [rit] Et tout le monde ici écoute, tout le monde, les fesses serrées.
Crash: Oh!
Mars: Et il y en a eu deux. On aurait cru que ça disait « rock » pourtant, alors je crois que ça peut passer.
Ginge: « Get the video / Rock me so good ».
Mars & Crash: Rock me so good.
Crash: C’est bien ça que ça disait.
Ginge: Ouais.
Crash: C’est ça que tout le monde a entendu.
Mars: La famille NOW est en train de faire son calcul. Ils disent « oups, t’en as oublié deux là, Ginge » [tout le monde rit]. Désolé.
Crash: Ah, c’est bon, c’est bon.
Mars: C’est quand même bien. C’était bon, c’était bon.

Le CCNR a reçu une plainte le 24 janvier concernant la chanson. La plaignante s’en prenait surtout à la répétition du mot « bitch ». Elle note qu’on s’est efforcé de censurer le mot fuck, mais qu’on a laissé le mot bitch. Elle conclut son message avec ces mots : [traduction] « Je ne veux pas que mes enfants entendent cela sur ce que je croyais être de la radio propre, parce que les enfants répètent tout ce qu’ils entendent. »
NOW! Radio a répondu à la plaignante le 25 janvier. La station s’est excusée d’avoir offensé la plaignante, mais a fait remarquer que la chanson, bien qu’elle ne fasse pas partie de sa sélection régulière, était tout à fait pertinente, le sujet du jour étant les mariages trash.
La plaignante a déposé sa demande de décision le 29 janvier. Elle suggérait que l’émission pourrait avoir enfreint l’article 9 du Code de déontologie de l’Association canadienne des radiodiffuseurs (ACR) concernant les émissions de radio. Elle se demandait si le mot « bitch » ne devrait pas être considéré comme indûment grossier et injurieux en ajoutant que, même s’il ne s’agit évidemment pas d’une émission pour enfants, l’émission matinale de cette station convient normalement à toute la famille.
Le 9 mai, CKNO-FM a adressé un supplément d’information directement au CCNR. Le radiodiffuseur a expliqué que cette chanson ne faisait pas partie de sa discothèque et que si elle avait été diffusée, c’était pour illustrer le sujet dont discutaient les animateurs de l’émission ce matin-là. La station a aussi expliqué que le producteur s’était hâté de retirer tous les mots fuck avant de la mettre en ondes, mais qu’il en avait raté deux. Le producteur et les animateurs ont été avisés de la plainte et [traduction] « ils étaient tous d’accord que rien ne requiert une diffusion assez urgente pour qu’on prenne le risque d’enfreindre le Code de déontologie de l’ACR ». LA DÉCISION
Le comité décideur anglophone a étudié la plainte à la lumière de l’article 9(c) du Code de déontologie de l’ACR :
Reconnaissant que la radio est un média local et qu’il reflète par conséquent les normes de la collectivité desservie, les émissions diffusées aux ondes d’une station de radio locale doivent tenir compte de l’accès généralement reconnu à la programmation qui est disponible sur le marché, de la répartition démographique de l’auditoire de la station et de la formule empruntée par la station. Dans ce contexte, les radiodiffuseurs prendront un soin particulier de veiller à ce que les émissions diffusées à l’antenne de leurs stations ne comprennent pas :
[...]
c) du langage qui est indûment grossier et injurieux.
Les membres du comité décideur ont lu toute la correspondance afférente et ont écouté un enregistrement de la diffusion en question. Le comité conclut que CKNO-FM a enfreint l’article 9(c) en laissant passer en ondes le mot fuck au cours de l’émission du matin.
La question à laquelle avait à répondre le comité décideur :
Est-ce que CKNO-FM a enfreint l’article 9(c) du Code de déontologie de l’ACR en diffusant la chanson « Crazy Bitch » qui répète plusieurs fois le mot bitch et pour avoir omis par deux fois de supprimer le mot fuck?
Le CCNR a déjà publié une décision sur la chanson « Crazy Bitch » dans laquelle il concluait que le mot bitch prononcé même en plein jour n’enfreint pas le Code de déontologie de l’ACR. Le comité n’avait alors décelé aucun problème dans les allusions sexuelles ou le thème général de la chanson. À condition de supprimer le mot fuck, la chanson pouvait être jouée à n’importe quel moment de la journée [1].
Le comité estime lui aussi que l’utilisation du mot « bitch », même à répétition comme dans cette chanson, ne constitue pas une infraction au Code de déontologie de l’ACR. Cette chanson n’est sans doute pas du meilleur goût, mais le CCNR soutient depuis toujours que les questions de goût doivent se régler par l’emploi de la commande marche-arrêt.
Dans leur hâte à diffuser la chanson, les animateurs ont laissé passer deux fois le mot fuck dans la version de la chanson qui a été entendue sur les ondes de la station. Ils s’en sont rendu compte, et ont même plaisanté à ce sujet. Ils ont traité cette omission à la légère et se sont contentés de dire « désolé » à la fin du segment.
En ce qui concerne l’utilisation du mot fuck et ses variantes dans des chansons, le CCNR a toujours maintenu que ce genre de langage constituait une infraction du Code de déontologie de l’ACR lorsque diffusé durant la journée ou en début de soirée [2].
Les compagnies de disque distribuent souvent plusieurs versions d’une même chanson dans le but d’éviter ce genre de problème. Les animateurs ont eux-mêmes reconnu que jouer la chanson présenterait un problème s’ils n’en retiraient pas le mot fuck. Bien que le comité soit conscient que les animateurs ont voulu réagir en temps réel au sujet du jour, il y a eu un manque de diligence de la part des animateurs et le résultat a été la diffusion d’une chanson renfermant deux fois le mot fuck. Par conséquent, le comité conclut que la station a enfreint le Code de déontologie de l’ACR.
Le comité estime également que s’excuser en disant tout simplement « désolé » au milieu des rires n’était pas suffisant. Les animateurs avaient l’occasion de présenter des excuses plus adéquates, et ils l’ont laissé passer.
Réceptivité du radiodiffuseur
Dans toutes les décisions rendues par le CCNR, ses comités évaluent dans quelle mesure le radiodiffuseur s’est montré réceptif envers le plaignant. Bien que le radiodiffuseur ne soit certes pas obligé de partager l’opinion du plaignant, sa réponse doit être courtoise, réfléchie et complète. Dans la présente affaire, CKNO-FM dans sa réponse a satisfait à son obligation de répondre adéquatement à la plainte. Ce radiodiffuseur ayant rempli son obligation de se montrer réceptif, il n’y a pas lieu d’en exiger davantage de sa part.
ANNONCE DE LA DÉCISION
CKNO-FM est tenu : 1) de faire connaître la présente décision selon les conditions suivantes : une fois pendant les heures de grande écoute, dans un délai de trois jours suivant sa publication, et une autre fois dans un délai de sept jours suivant sa publication, dans le même créneau horaire que Crash & Mars, mais pas le même jour que la première annonce; 2) de faire parvenir à la plaignante qui a présenté la demande de décision, dans les quatorze jours suivant la diffusion des deux annonces, une confirmation écrite de son exécution; et 3) au même moment, de faire parvenir au CCNR copie de cette confirmation accompagnée du fichier-témoin attestant la diffusion des deux annonces, qui seront formulées comme suit :
Le Conseil canadien des normes de la radiotélévision a jugé que CKNO-FM (NOW! Radio) avait enfreint le Code de déontologie de l’Association canadienne des radiodiffuseurs dans une diffusion de l’émission Crash & Mars le 24 janvier 2018. La station, en diffusant au cours de son émission du matin une chanson renfermant le mot fuck, a contrevenu à l’article 9 dudit code.
La présente décision devient un document public dès sa publication par le Conseil canadien des normes de la radiotélévision.[1] CKQB-FM concernant la chanson « Crazy Bitch » par Buckcherry (Décision CCNR 10/11-1169, 22 septembre 2011).

Crash & Mars is the morning show on pop-rock music station CKNO-FM (NOW! Radio, Edmonton). It is hosted by Crash and Mars and their co-host Ginge. On January 24, 2018, just after 8:00 am, they broadcast the following:

Crash: Everything. Ginge literally has pulled out, like, probably, 15, 20 f-bombs out of the song.

APPENDIX B
The Complaint
The following complaint was submitted via the CBSC’s webform on January 24, 2018:
Television or Radio Station: 102.3 Now! Radio
Program Name: The Crash and Mars Show
Date of Program: 2018/01/24
Time of Program: 8:00 am
Specific Concern: Playing a song that has the word B*tch in it several times and also saying the word b*tch. They bothered to censor all the F bombs (which is great) but none of the B-words. Is this word no longer a censored word? I don't want my children to hear this on what I thought was clean radio, as children repeat everything they hear.

I am sorry if we have offended you. The Jim Pattison Broadcast Group strives to provide quality programming that all listeners can enjoy.
I have reviewed the audio from the show and topic you referenced. Specifically, your concern was about the airing of the song “Crazy B*itch” by the group Buckcherry. This song is not regularly on the station’s playlist but was tied to their topic about trashy weddings. Specifically, they shared a story about a bride who used this song as her “exit theme” from her own wedding and how guests were stunned by this unusual choice.
We do not believe the content aired was in violation of the CBSC code.

The complainant filed her Ruling Request on January 29:
Thank you for your response.
In the station's response, they only discussed the fact that they played a song that included swears, that's not normally in their normal circulation of music, as it was in relation to their topic of discussion. I understand this, however, both of the DJs were saying b*tch several times when they were discussing the topic in relation to them playing this song. I do not think they were within CBSC code, as it indicates:
Clause 9 – Radio Broadcasting
Recognizing that radio is a local medium and, consequently, reflective of local community standards, programming broadcast on a local radio station shall take into consideration the generally recognized access to programming content available in the market, the demographic composition of the station’s audience, and the station’s format. Within this context, particular care shall be taken by radio broadcasters to ensure that programming on their stations does not contain:
(a) Gratuitous violence in any form, or otherwise sanction, promote or glamorize violence;
(b) Unduly sexually explicit material; and/or
(c) Unduly coarse and offensive language.
Are they saying that that word, which was repeated several times, is not considered unduly coarse, and offensive language anymore these days?
I understand that this is not a children's program, but it is a family program that airs on a public wavelength, and therefore should fall within the clause noted above.
I am not intending to stir the pot, I just wish to help make our public radio stations a bit more family friendly, and follow the public guidelines that are set in place for reasons exactly as this.

The CBSC informed the station that this complaint would be adjudicated and offered them an opportunity to add any final comments to the file. CKNO-FM sent the following letter on May 9:
I received your email from yesterday regarding CBSC ref. 20.1718-0881.1 and the response we sent the complainant, [C. H.].
We acknowledge that two instances of the f-word were accidentally left in the version of the song “Crazy Bitch”, which aired on CKNO-FM on January 24th, 2018. As the complainant did not mention any airing of the f-word, we did not mention this in our reply.
The song “Crazy Bitch” is not in our regular music library on CKNO. As the song was specifically tied to the content the morning show was talking about, the show producer rushed to find the song and then edit out all the f-words before airing. Unfortunately, in his hurry to get the song to air, the producer missed editing out two of the f-words.
After we became aware of this incident, I spoke to the Program Director, the morning hosts and the show producer to ensure that a mistake of this nature would not happen again. We all agreed there is nothing that so urgently needs to get on air that we need to risk any possible violation of the CAB Code of Ethics.
